These Terms of Service ("Terms") constitute a legally binding agreement between you and Gilgamesh Technologies LLC ("Gilgamesh," "we," "us," or "our") governing your access to and use of the Gilgamesh mobile application (the "App"). By creating an account or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.
The App is rated 17+ and intended for users who are at least 18 years old, or the age of legal majority in their jurisdiction. By using the App, you represent that you meet this requirement. Age category and parental consent information for users identified as minors may be provided to us by the applicable app store as required by law; where such information indicates a user does not meet our eligibility requirements, we reserve the right to restrict or terminate access to the App.
You must create an account to use most features of the App. You agree to provide accurate information and to keep your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at contactus@gilgameshapp.com if you suspect unauthorized access to your account.
The App provides fitness tracking (Temple), nutrition and macro tracking (Macros), financial tracking tools (Vault), a social community feature (Tavern), an achievement and profile system (Uruk), and related features. Features and availability may change, be added, or be removed at our discretion at any time.
The App offers an optional auto-renewing subscription, "Gilgamesh Pro," which unlocks additional features as described within the App. Subscriptions are billed through Apple's In-App Purchase system at the price displayed at the time of purchase.
Your subscription automatically renews at the end of each billing period unless cancelled at least 24 hours before the renewal date. Payment is charged to your Apple ID account. You can manage or cancel your subscription at any time through your Apple device's subscription settings.
All payments are processed by Apple. Refund requests are subject to Apple's refund policies. We do not directly process refunds.
We reserve the right to modify the features included in Gilgamesh Pro at any time, provided that we will not materially reduce the value of an active subscription without reasonable notice.
"Mesh" is a virtual, in-app engagement reward point system. Within the App, Mesh is not currency, has no monetary value, cannot be purchased with real money, and cannot be exchanged, redeemed, transferred for, or converted into cash or any other thing of monetary value. Mesh is never sold or offered for sale within the App; it is earned exclusively through engagement as described in Section 6.2, or granted promotionally at our discretion. Mesh is merely a digital item licensed to you for use within the App, and you receive no ownership interest in Mesh.
If Mesh is ever represented by a blockchain-based token as described in Section 6.4, that token may become tradable on third-party decentralized exchanges or platforms outside of the App. We do not operate, control, or endorse any such third-party exchange or marketplace, make no representation as to the price or liquidity of any such token on those platforms, and bear no responsibility for transactions conducted there. The restrictions in this Section 6.1 apply solely to activity within the App itself.
Mesh may be earned through a monthly distribution based on community honors received, through tips sent by other users, or through other mechanisms we may introduce. Mesh may be used within the App to tip other users or for other in-app features we may introduce. We reserve the right to determine, adjust, or modify how Mesh is earned, calculated, capped, distributed, or used at any time, in our sole discretion.
We make no representation, warranty, or promise — express or implied — that Mesh has, will have, or will retain any value, whether monetary, exchangeable, or otherwise. Any future plans referenced within the App or our marketing regarding blockchain technology, token distributions, or airdrops are potential future roadmap items only, are not guaranteed, are subject to change or cancellation without notice, and do not constitute an offer or sale of any security, investment, or financial product.
We may, at our sole discretion and at an unspecified future date, choose to enable users to associate a self-custodied digital wallet with their account for the potential purpose of receiving a distribution of a blockchain-based token corresponding to earned Mesh balances. If implemented:
We reserve the right to suspend, reduce, or permanently revoke a user's Mesh balance, with or without notice, if we determine in our sole discretion that the user engaged in gaming, botting, fraud, manipulation, or other abuse of the Mesh system or our Community Rules.
The Vault feature, including but not limited to net worth tracking, budgeting tools, debt payoff planning, retirement calculators, and investment watchlists, is provided for general informational and educational purposes only. These tools rely on data and assumptions you provide and on third-party market data that may be delayed, inaccurate, or incomplete.
Gilgamesh is not a registered investment advisor, broker-dealer, financial planner, accountant, or legal professional. Nothing within the App constitutes financial, investment, tax, or legal advice, or a recommendation to buy, sell, or hold any security or financial product. No fiduciary relationship is created between you and Gilgamesh through your use of the App. You should consult a qualified, licensed professional before making financial decisions.
We do not guarantee the accuracy, completeness, or timeliness of any market data, calculations, or projections displayed within the App. You assume all risk associated with reliance on this information. Investing involves risk, including the possible loss of principal.
The Temple and Macros features are provided for general fitness and nutrition tracking purposes only and do not constitute medical advice. Gilgamesh is not a substitute for professional medical, nutritional, or fitness guidance. Consult a physician or qualified health professional before beginning any exercise or nutrition program, particularly if you have any pre-existing health conditions. You assume all risk associated with any exercise or dietary changes undertaken based on information tracked or displayed within the App.
The App's AI-powered macro scanning feature provides estimated nutritional information based on photo analysis. AI-generated estimates may be inaccurate or incomplete. You should not rely solely on these estimates for medical, dietary, or health-related decisions, particularly if you have allergies or medical dietary restrictions.
You retain ownership of content you create and post within the App (including posts, replies, comments, images, and videos in the Tavern feature). By posting public content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content within the App for the purpose of operating the Service.
All use of the Tavern and other community features is subject to our Community Rules, accessible within the App. Violations may result in content removal, shadowbanning, suspension, or permanent account termination at our sole discretion.
You agree not to: post unlawful, harassing, hateful, or sexually explicit content; impersonate any person or entity; attempt to manipulate the Mesh system, honors, rankings, or achievements through fraudulent or automated means; upload malware or attempt to compromise the App's security; or use the App for any unlawful purpose.
We use a combination of automated systems and user reports to moderate content. We reserve the right, but assume no obligation, to review, remove, or restrict access to any content at our sole discretion.
You agree not to reverse engineer, decompile, disassemble, or attempt to extract the source code of the App, except where such restriction is prohibited by applicable law; use bots, scripts, scrapers, or other automated means to access or interact with the App; or otherwise interfere with or disrupt the App's infrastructure or security.
The App, including its design, graphics, logos, trademarks (including "Gilgamesh"), and underlying code, is owned by Gilgamesh Technologies LLC and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
You may delete your account at any time through the App's Settings.
We may suspend or terminate your account at any time, with or without notice, for violation of these Terms, our Community Rules, suspected fraudulent or abusive activity, or for any other reason in our sole discretion.
Upon termination, your right to use the App ceases immediately. Any Mesh balance, achievements, or other in-app status will be forfeited and are not refundable or transferable, as Mesh has no monetary value as described in Section 6.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DATA, CALCULATIONS, OR AI-GENERATED CONTENT WILL BE ACCURATE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GILGAMESH TECHNOLOGIES LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, ANY CONDUCT OR CONTENT OF ANY USER, ANY FINANCIAL, FITNESS, OR NUTRITIONAL DECISIONS MADE IN RELIANCE ON THE APP, OR ANY MESH BALANCE OR FUTURE TOKEN DISTRIBUTION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) FIFTY DOLLARS ($50 USD).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Gilgamesh Technologies LLC and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, your violation of any rights of a third party, or any content you submit through the App.
You are solely responsible for the accuracy of data you input into the App, including financial, fitness, and nutritional information. We are not responsible for any consequences arising from inaccurate data entry, misuse of App features, misunderstanding of calculator results, or decisions made based on your own use of the App.
Before filing a claim, you agree to first contact us at contactus@gilgameshapp.com to attempt to resolve the dispute informally.
Except where prohibited by law, any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration on an individual basis, rather than in court, except that either party may bring an individual claim in small claims court. YOU AND GILGAMESH EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.
To the extent any user is a minor under applicable law, the arbitration and class action waiver provisions of this Section shall not be enforced against that minor without verifiable parental or guardian consent obtained in accordance with applicable law.
These Terms are governed by the laws of the State of Missouri, without regard to its conflict of laws principles, except where superseded by applicable federal law or by mandatory consumer protection laws of your jurisdiction of residence.
We may modify these Terms at any time. Material changes will be communicated through an in-app notification or by updating the "Last Updated" date. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
